Heads up before you scroll: sections 21 and 22 below mean that most disputes with Lendercompare go to individual arbitration instead of court, and that neither side can join a class action. Please read them properly.
01 What Lendercompare does
Lendercompare runs a no-cost matching service for personal loans. You fill in one request, and we route it to lenders and other providers in our network so each of them can decide whether it might make you an offer. A request can go unanswered. Nobody is obliged to contact you, match you or offer you anything, and we make no promise about the result. Every lender picks its own states and makes its own call on whether to reply.
02 Accepting these terms, and updates to them
This page is a binding agreement between you and Lendercompare (called "we", "us" or "our" below). Browsing the site or sending us a request counts as saying yes to it. Said no? Then please stop using the site. From time to time we may publish a revised version here and change the date at the top. A revision takes effect on that date, and it never rewrites the rules for a request you sent earlier. A quick look at the date on each visit keeps you current.
03 Who may use the site
You need to be 18 or over, or older if your state sets a higher age of majority. You also need to be a U.S. resident with the legal capacity to sign a contract. Lenders in our network usually want to see steady income and a bank account held in your name, so plan on having both. Requests are strictly personal: send one for yourself only, and never for another person.
04 We don't lend, broker or represent anyone
Lendercompare is not a lender. We make no credit decisions, fund nothing, arrange nothing and broker nothing. We act as nobody's agent, yours or a lender's, and nothing here is financial, tax or legal advice. If a loan is offered, the deal is strictly between you and the lender who offers it, under that lender's terms. Go through its paperwork line by line before signing, and put any question about it to the lender itself.
A lender in our network may be tribally owned, meaning it belongs to a federally recognized Native American tribe and operates under that tribe's law. With a lender like that, the governing law, the loan agreement and the route for settling a dispute may not match what a state-licensed lender would offer, and certain protections under your state's law might not reach it. It's the lender's job to spell those points out in its own paperwork, so check them before you commit to anything.
05 How Lendercompare makes money
You never pay us a cent. Our income comes from lenders and providers in the network, who may pay a fee for a request we pass along, or for one that ends in a funded loan. Because of that, payments can shape which lender gets to see your request first and in what order offers appear on your screen. Our network doesn't cover every lender or product out there, and a lender's place in it is not our endorsement.
06 Checking what you tell us
Hitting submit gives us, plus the lenders and providers in our network, permission to verify what you've entered and to pull information about you from consumer reporting agencies and other data sources. Verification can cover your identity, your income and your bank account. To look for a match we use a soft inquiry, and your credit score doesn't move because of it. If you go on with a lender, it may run a check of its own, possibly a hard inquiry. The Credit Authorization in the footer has the full picture.
07 Who gets to see your request
A submitted request is your instruction to us to pass its details to network lenders, other providers and the service partners who help run Lendercompare, so they can look it over and get in touch with you about it. Each of those businesses may hold on to your details and use them under its own privacy policy, whether or not you accept an offer. For what we gather, who receives it and what you can control, see our Privacy Policy.
08 Other offers you might see
When no lender picks up your request, we or a partner may point you toward something else you might find useful, for example credit monitoring or money-management tools. Looking at those offers is optional, and so is signing up. Whatever you choose is covered by that provider's terms, not by ours.
09 Going paperless
You agree to receive notices, disclosures and other records from us in electronic form, by email or by a posting on this site, and you accept that doing so satisfies any rule requiring them in writing. Checking a box or clicking a button on this site acts as your electronic signature. To get these records, keep a device that reaches the internet, a browser that's kept up to date, and a working inbox. Pulling this consent is possible any time by email, though we may not be able to keep handling your request afterward. Want something on paper instead? Email us and we'll send a printed copy.
10 Phone calls, texts and email
By submitting and agreeing to be contacted, you let us, network lenders and our partners reach you about your request and related products through calls, texts and emails to the number and inbox you provided. Those contacts may use autodialers and prerecorded or artificial voices. Giving that permission is never required to buy anything. Message and data rates may apply. Text STOP at any point, or head to our Unsubscribe page. More detail sits in our TCPA Disclosure.
11 Your personal information
Our Privacy Policy covers how we collect, use, share and safeguard personal information, and it is part of this agreement. If you live in California, the Do Not Sell or Share My Information page lays out your rights.
12 Promises you make
Each time you use Lendercompare, you confirm that:
- the details you give are accurate, complete and about you, and you'll update us if they change while a request is still open;
- you fit every requirement in section 03;
- the phone number and email you enter are your own, or you have permission to use them;
- you won't use the site to break the law, deceive anyone, or interfere with, overload or break into it; and
- you won't point bots, scrapers or similar tools at the site to copy or harvest its content.
13 Who owns the site
Text, graphics, layout and everything else on this site belong to us or our licensors, protected under copyright, trademark and related law. Feel free to read and print pages for your own personal reference. Copying, editing, republishing, selling or otherwise reusing them needs our written say-so first.
14 Links that leave the site
Links here, along with any offer shown after you submit, may send you to sites operated by lenders and other businesses. Those sites are outside our control, and so are their content, their terms and their handling of your data. Clicking through is your decision, and the other site's own terms and privacy policy govern what happens there.
15 No warranties
We try to keep the site correct and online, but it comes to you "as is" and "as available". As far as the law permits, we give no warranty of any kind, express or implied. That includes any warranty that the site suits your purpose, stays up, stays secure or contains no errors, and any warranty that a lender will answer your request or offer you credit. We also give no warranty about the terms, quality or fit of anything a lender or provider offers you.
16 A cap on what we owe
As far as the law permits, Lendercompare is not liable for indirect, incidental, special, consequential or punitive damages tied to your use of the site, your request or anything between you and a lender or provider, even where someone warned us that such damages could happen. For any claim about the site or the service, the most we will ever owe you is what you paid us for the service, which is nothing. A few states restrict limits like these, so some of this section might not cover you.
17 Indemnity
Should you breach these terms, feed us false details or use the site illegally, you agree to protect Lendercompare, its owners, employees and partners against every resulting claim, loss and cost, reasonable attorney fees included.
18 Glitches, outages and errors
We're not answerable for any hold-up or failure caused by events beyond our reasonable control. Think network or power cuts, a lender's or partner's systems going down, or details that were typed in wrong. When we find an error on the site we fix it, and any part of the site may be changed or taken offline at any time without warning.
19 Release
Loans and other products come from lenders and providers, never from Lendercompare. As far as the law permits, you release us from all claims, demands and damages that grow out of any dispute between you and a lender or provider. California residents also give up the protection of California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
20 Tell us before you file
Before bringing an arbitration or any other claim against us, send a written notice to [email protected] with your name, your contact details, a description of the problem and the outcome you want. We'll make an honest effort to settle things with you directly. If there's no resolution 60 days after your notice reaches us, either side may begin arbitration under section 21.
21 Binding individual arbitration
This section takes away your right, and ours, to have a judge or a jury decide a dispute. Read it with care.
Any dispute or claim between you and us that arises out of or relates to these terms, the site or the service will be resolved by binding arbitration, one claimant at a time, and not in court. That includes any argument about whether this section covers a dispute or can be enforced. A single arbitrator will hear the case through the American Arbitration Association (AAA), applying its Consumer Arbitration Rules, available at adr.org. The Federal Arbitration Act controls this section. Hearings will be held in California, or by phone or video call if you ask for that. Any AAA filing, administrative or arbitrator fees above the cost of filing the same claim in court are ours to pay, unless the arbitrator decides you filed in bad faith. Whatever personal relief a judge could order, the arbitrator can order too, and the resulting award may be turned into a judgment by a court with jurisdiction.
There's one exception: a claim that fits within small claims court may be filed there by you or by us, for as long as it stays a single-person small claims case. To opt out of this arbitration agreement, email us no later than 30 days after your first visit to the site, giving your name and saying plainly that you are opting out. Opting out leaves the rest of these terms untouched.
22 Class action and jury waiver
Claims between you and us are brought one person at a time. Neither of us may bring or take part in a class action, collective action, combined action or representative action against the other, whether as a named plaintiff or a class member. An arbitrator cannot merge claims from different people or oversee any kind of class or representative proceeding. If a court holds this section unenforceable as to a specific claim, that claim goes to court rather than arbitration, while sections 21 and 22 keep applying to all other claims. On top of that, you and Lendercompare each waive a jury trial for every claim covered here.
23 Copyright notices (DMCA)
We take intellectual property rights seriously. To report material on this site that you believe infringes your copyright, email [email protected] with the information the Digital Millennium Copyright Act requires. That means naming the copyrighted work and the material you say infringes it, showing where it appears on the site, and giving your contact information. Add a statement that you believe in good faith the use is unauthorized, plus a statement under penalty of perjury that your notice is accurate and that you own the copyright or may act for the owner. Sign it physically or electronically.
24 Notice to California users
California Civil Code section 1789.3 entitles users in California to this notice. Lendercompare costs you nothing to use. Send any question or complaint about the service to [email protected]. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
25 Governing law and the fine print
This agreement is governed by the laws of the State of California, setting aside that state's conflict-of-law principles, and section 21 is also governed by the Federal Arbitration Act. Anything that doesn't go to arbitration belongs in state or federal court in California, and both sides accept those courts' jurisdiction. A provision found unenforceable drops out without taking the rest of the agreement with it. Holding off on enforcing a provision doesn't waive it. Your rights under this agreement can't be assigned by you, though ours may be assigned by us. Section headings are only signposts and carry no legal meaning.
26 Entire agreement
This page, our Privacy Policy, our TCPA Disclosure and every other document referred to here make up the full agreement between you and us about the site and the service, and they override any earlier understanding. A loan contract you sign with a lender stands on its own and sits outside this agreement.
